Domestic Violence Penalties in Texas

Texas legally classifies domestic violence in three ways: domestic assault, aggravated domestic assault, and continuous violence against one's family. Depending on the crime and the specific circumstances surrounding it, there are a variety of penalties that could be imposed upon those who are found guilty.

Domestic violence crimes are punishable as follows:

  • Class A misdemeanor: up to 1 year in jail or a fine of up to $4,000, or both
  • Third-degree felony: 2 to 10 years in prison and a fine of up to $10,000
  • Second-degree felony: 2 to 20 years in prison and a fine of up to $10,000
  • First-degree felony: 5 to 99 years in prison and a fine of up to $10,000

In addition to these penalties, a person convicted of domestic violence may be required to pay restitution directly to victims to cover the cost of medical treatment, counseling, or replacement of damaged property.
