What Amount of Drugs is Considered Trafficking?

Under the Texas Controlled Substances Act, an offense under statute §481.112 has very specific guidelines for the amount of drugs that is considered trafficking in Texas.

  • State Jail Felony - if the amount of the substance is (by aggregate weight) including dilutants or adulterants less than one gram.
  • First Degree Felony - if the amount of the substance is (by aggregate weight) including dilutants or adulterants four grams or more but less than 200 grams.
  • Second Degree Felony - if the amount of the substance is (by aggregate weight) including dilutants or adulterants one gram or more but less than four grams.
