DUI vs. DWI in Texas

In Texas, the acronyms DUI (driving under the influence) and DWI (driving while intoxicated) both refer to an individual who drives a motor vehicle while intoxicated. The main difference between DUI and DWI pertains to the age of the driver. When a person who is 21 years of age or older operates a motor vehicle while legally intoxicated (0.08% blood alcohol concentration), he or she may be charged with DWI. A driver testing 0.15% or more over the legal limit of 0.08% faces more severe penalties for higher BAC.

Drivers who are under the age of 21 are not allowed to have any blood alcohol content. If an underage driver tests positive for any amount of blood alcohol content, he or she may be charged with DUI.
