I-601 Waivers

The law generally requires those who have lived in the United States unlawfully to leave the country and wait for 3 to 10 years before reentering. The I-601 waiver is designed to help qualifying individuals avoid the long wait period. In order for this type of waiver to be accepted, you must demonstrate that deportation or barred re-entry would cause extreme hardship to a qualifying relative.

This means that the government requires that you provide sufficient evidence that shows how a certain family member would experience hardship beyond what is usually expected for deportation cases.

Factors that may support a finding of extreme hardship include:

  • Family ties and impact: responsibility for the care of any family members in the United States
  • Social and cultural impact: fear of persecution of societal discrimination
  • Economic impact: financial effect of applicant’s departure on the qualifying relative
  • Health conditions and care: psychological impact on the qualifying relative due to the suffering of the applicant
  • Country conditions: conditions in the country of relocation that jeopardize safe repatriation or lead to a reasonable fear of harm

The presence of any of the above factors, or others like them, does not necessarily mean that extreme hardship would result if an individual is denied admission. When making a determination of extreme hardship, the government will consider the factors presented in light of the totality of the applicant’s circumstances.
