When to Report a Car Accident in Texas

A common question we are asked is, “To whom should I report a car crash?” There are two places that you might need to notify about your auto accident, depending on the severity of the damages. First, some crashes will require that you immediately report it to the local police department (if it occurs within a municipality) or sheriff’s office (if outside a municipality).

Texas’ Comparative Negligence Rule

Generally, if the other driver in your automobile accident was entirely at fault, he or she will be responsible to compensate you for damages, typically through their insurance carrier.

If you were partly at fault for the crash, Texas law follows a modified comparative fault rule. This means that the compensation you are awarded will be reduced by a percentage equal to your share of fault. For example:

  • If the damages are found to equal $50,000, but you were 40% at fault, you will receive 60% of the $50,000, or $30,000. In order to recover damages, you must be no more than 50% at fault.
