Recovering Compensation for Dog Bites in Texas

 

There are two primary grounds for compensation for dog bite victims in Texas. The first is known as the one-bite rule.

  • The dog previously bit a person or acted like it wanted to

  • The defendant was aware of the dog’s previous conduct

According to the law in the state of Texas, victims of dog bites are eligible to receive compensation under the grounds of  negligence. This law states that the owner is liable for their negligence in handling their animal. 

To receive compensation for negligence, the following must apply:

  • The defendant owned or possessed the animal

  • The defendant had a duty to exercise reasonable care and prevent the animal from injuring others

  • The defendant breached that duty

  • The defendant’s breach was the primary cause of the plaintiff’s injury
